■ Distinction between Crimes vs Civil Wrong

> Crime 범죄의 결과로 Fine to life-imprison에 처해짐 ( Prosecutor prosecutes Defendant )

> Civil Wrong (범법행위) : Claimant(=Plaintiff:원고) sues a Defendant

   이에 따른 배상은 (Following Remidy)는 Damage or Injunction(Order) or Specific Performance

■ Common Law

  > Contract Law / Tort Law / Professional Negligence / Family law / Advocacy / Property law / Environment Law

위 중에서 Construction Law는 따로 존재하지는 않지만 Contract / Tort / Professional Negligence가 함께 나타내는 양상

■ Civil Court (법정)

 > 1심 : High Court  or County Court by Judge(J)

            High Court (Queen's Bench / Chancery / Family Div.) 

            Construction (Technology and Construction Court : TCC)--> Commercial Court in Queen;s Div

 > 2심 : Court of Appeal by Lord Justice(LJ)

 > 3심 : House of Lords by Lord of Appeal(L)

■ Terminology & Glossary

 - Consideration : Payment or money

 - Bilateral Contract 

 - Unilateral Contract (개인의 의지 반영된 경우)

 - Caveat emptor : 파는 자는 사는자가 알도록 해야한다 (Willful Concealment --> Void Contract)

 - Contra proferentem rule : 포함사항이나 애매모호한 항에 대해서 계약작성자가 더 불리하게 해석함 

 - Condition Precedent : Event는 계약 후에 일어나야

 - Dictum : 라틴어로 Remark 

 - Obiter Dicta : 판결에 영향을 미치지 않은 

 - Duress : 의사와 반하도록 행위를 하게 만드는 것

 - Breach of Contract : 이행실패
